NEW OR AMENDED BANKRUPTCY FORMS

Official Form B 1 – Amended to implement new Bankruptcy Rule 1004.2 which requires an entity filing a chapter 15 petition to state the country of the debtor’s main interest and each country in which a case involving the debtor is pending.

Official Forms B 9A – 9I – Amended to implement amended Bankruptcy Rule 2003(e) requiring the trustee or other presiding official to adjourn a Section 341 meeting to a specific date and time.

Official Form B 10 – Amended to implement amended Bankruptcy Rule 3001(c) which requires writings supporting a claim or evidencing a security interest to be attached rather than summarized. 

Official Form B 10A -- Attachment A to a proof of claim is now required for individual debtor cases.  Attachment A implements amended Bankruptcy Rule 3001(c)(2) which requires a statement of principal and interest due as of petition date, a statement of prepetition fees, expenses and charges and a statement of the amount necessary to cure a default be included in a proof of claim.

Official Form B 10S1  -- Supplement 1 to a proof of claim is required by new Bankruptcy Rule 3002.1(b) and gives required notice of payment changes on claims secured by a debtor’s principal residence. 

Official Form B 10S2 – Supplement 2 to a proof of claim is required by new Bankruptcy Rule 3002.1(c)  and gives notice of post-petition fees, expenses and charges incurred in connection with a claim secured by a debtor’s principal residence.

Official Form B 25A  -- Amended to reflect the effective date provision of the model small business plan to reflect the correct time of 14 days for filing a notice of appeal.
